Mass DPH has begun to implement the statute which requires  WIC for all psycho-tropic medications at nursing and rest homes. Many agree that there should be some modification of the circular letter which directs facilities how to implement. Among the issues are the list of medications which should need WIC, the time from admission to obtain the consent, who on staff should provide the consent, etc. Legislation will be required for some of this and modifications in the letter will do the rest. Consent may be obtained from the resident or ,when necessary, the health care proxy(HCP), or  guardian.
A work group convened by DPH continues to meet and is considering these and other issues as they arise.
