2011 Rogers Guardianship Changes

The Massachusetts Probate Court has issued regulations(effective July 1, 2011) for uncontested reviews and extensions of Rogers Guardianships(those which authorize the use of antipsychotic medications) for incapacitated persons- IP).
These may now be submitted to the court in an administrative procedure without having a hearing.
Initial petitions shall continue to be heard by a judge.
 

The following are among the necessary requirements for these new procedures:

  • The extension and/or amendment for an existing plan may not exceed twelve months.
  • Completed clinician's affidavit and treatment plan which may not include more than four changes
  • Examination of the IP must have been completed within sixty days.
  • Report by the Rogers monitor(indicating there has been a meeting with the IP).
